Holiday rental licence in Andalusia: requirements and steps

To rent to tourists you need a holiday rental licence in Andalusia: register the home in the Andalusian Tourism Register with a responsible declaration and show that number on your listings. Since April 2025 the owners' community must approve it by three fifths. The national number (NRA) was annulled by the Supreme Court in May 2026, and some town halls limit new licences.
Holiday rental licence in Andalusia: the registers in 2026
| Requirement | Managed by | Status in 2026 |
|---|---|---|
| Andalusian Tourism Register (RTA) | Junta de Andalucía | Mandatory: its number goes on every listing |
| National rental registration number (NRA) | Land Registry | Annulled by the Supreme Court (ruling 620/2026) |
| Guest registration (SES Hospedajes) | Ministry of the Interior | Still mandatory |
The Supreme Court held that the State had no power to create its own tourist rental register, because the matter belongs to the regions. Platforms still send data to the national digital window, but the number that counts is the Junta's.
Requirements for the property
- First-occupation licence or certificate of habitability.
- Air conditioning in bedrooms and living room, and heating if you will rent in winter.
- First-aid kit, local tourist information and complaint forms.
- Bed linen and kitchenware for the number of guests.
- Community approval, if the licence is requested after 3 April 2025.

Step by step to get the licence
- Check that your town hall allows new tourist rentals in that area.
- Get the community's approval by a 3/5 majority, if required.
- File the responsible declaration on the Junta's website, with the cadastral reference and occupation licence.
- Register with SES Hospedajes to report your guests' details.
- Show the Andalusian Tourism Register number on all your listings.
Registration with the Junta takes effect when you file the declaration, although inspections can follow. If you already had an NRA, keep it on file, but the number that must appear is the regional one.
Before buying to rent: run the numbers
Work out the return with cautious figures. A guide example for a 2-bedroom apartment on the coast:
| Item | Yearly example |
|---|---|
| Income (120 nights at €120) | €14,400 |
| Management and cleaning (20-25%) | -€3,200 |
| Community fees, IBI, utilities and insurance | -€3,000 |
| Return before tax | €8,200 |
These are example figures, not a promise. Ask for real occupancy data for the area and remember to deduct taxes based on where you live.
Local limits and other recent changes
Several Andalusian town halls have paused new licences in saturated neighbourhoods. Málaga city, for example, has limited new tourist rentals across much of the city. Ask the town hall before you sign.
The rules have changed several times in two years and may change again. Check the situation in the same month you plan to sign. And remember that the income is taxed: we explain it in non-resident property taxes.
If you want a home with rental demand, consider areas such as Torremolinos or Las Lagunas de Mijas, and check each community's rules first.
Frequently asked questions
What do I need to rent my home to tourists in Andalusia?
Registration in the Andalusian Tourism Register, sign-up with SES Hospedajes and, since April 2025, the community's approval by a three-fifths majority.

Yes. The statutes can ban them and, for new licences since April 2025, the community must expressly approve them by three fifths.
Are there areas where no new licences are granted?
Yes. Some town halls, such as Málaga city, have limited new tourist rentals in certain neighbourhoods. Check before buying.
